This Privacy Policy will only be valid for the personal data obtained in the website, not being applicable for the information collected by third parties in other websites, even if they are directly linked from this site.

ERSHIP S.A.U. has adapted this website to the requirements of the Spanish Organic Act 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), and also complies with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons (RGPD), as well as with the Act 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE).

In ERSHIP we process the information provided by the interested parties for the following purposes:

> C.V.– Management of the curriculum vitae received for job applications.

> Complaints Channel– To prevent and detect any irregular, illicit or criminal conduct.

There are other purposes for which we process your personal data:

> To ensure compliance with the terms of use and applicable law or to support and improve the services offered by this website. This may include the development of tools and algorithms that help this site to ensure the confidentiality of personal data collected.

> To manage the social networks in which ERSHIP has a presence. The treatment of the data that is carried out of the people who become followers in the social networks of the official pages of ERSHIP, will be governed by this section. As well as by those conditions of use, privacy policies and access regulations that belong to the social network in each case and previously accepted by the user. ERSHIP will process your data for the purposes of correctly managing your presence in the social network, informing you of our activities or services, as well as for any other purpose that the regulations of the social networks allow.

Under no circumstances do we use the profiles of followers in social networks to send advertising on an individual basis.

ERSHIP does not sell, rent or transfer personal data that can identify the user.

Accuracy and veracity of the data

As a user, you are the only one liable for the veracity and correctness of the data you send us, exonerating ERSHIP from any responsibility in this respect. The user guarantees and responds, in any case, of the accuracy, validity and authenticity of the personal data provided, committing to keep them properly updated.

Acceptance and consent

The User declares to have been informed of the conditions on the protection of personal data, accepting and consenting to the treatment of the same by ERSHIP in the form and for the purposes indicated in this privacy policy.

Commercial mails

In accordance with the LSSICE, ERSHIP does not carry out SPAM practices, so it does not send commercial e-mails by electronic means that have not been previously requested or authorized by the User. Consequently, in each of the existing forms in the web site, the User has the possibility of giving their express consent to receive any communication that will be properly identified, independently of the commercial information that has been specifically requested.

4. How long will we keep your data?

> Customers and suppliers: For the duration of the relationship or for as long as it is considered that this relationship can be established or recovered.

> Curriculum vitae: Eighteen (18) months in the event that the employment or professional relationship does not materialise.

> Complaints channel: Complaints received are retained to provide evidence of the functioning of the crime prevention model and to follow up on them, if necessary. Complaints that have not been followed up are retained in anonymised form.

We also retain your data to comply with the requirements of applicable law, prevent unlawful actions, resolve disputes, and other actions permitted by law, i.e. for the legally required time periods. Once we no longer need to process your data, we will delete and/or block it in accordance with our data retention and deletion policy and the legal statute of limitations in accordance with applicable law. After these deadlines, we will destroy your data.

5. What is the legal basis for processing your data?

Generally speaking, the legal basis for the processing of personal data provided in the contact is your consent. The lawfulness of the processing may also be based on the contractual or pre-contractual relationship between the parties or on the legitimate interest of ERSHIP, in accordance with the applicable law.

The consent given for the processing is revocable at any time by communicating it to ERSHIP in the terms established in this Policy for the exercise of your rights.

6. Browsing

When browsing the website non-identifiable data may be collected, which may include IP addresses, geographical location (approximately), a record of how our services and sites are used, and other data that cannot be used to identify the user. Non-identifying data also includes data relating to your browsing habits through third party services as detailed in the cookies section.

We may use this information to analyse trends, administer the site, track users’ movements around the site and to gather demographic information about our user base as a whole.

7. Data Secrecy and Security

ERSHIP is committed to the use and treatment of the data obtained, respecting its confidentiality and to use it in accordance with the purpose of the same, as well as to comply with its obligation to save it and to adapt all the measures to avoid its alteration, loss, treatment or unauthorized access, in accordance with what is established in the current data protection regulations.

ERSHIP shall ensure that any person who is authorised by our enterprise to process the personal data of the data subject (including its employees and partners) is bound by the obligation of confidentiality.

ERSHIP cannot guarantee the absolute impregnability of the Internet network and therefore the violation of the data through fraudulent access by third parties.

Upon becoming aware of a security breach, ERSHIP will notify such security breach to the Spanish Data Protection Agency, as well as to the affected users, where possible, without undue delay and by providing timely information related to such security breach.

8. To which recipients will your data be communicated?

ERSHIP’s website may provide access to other websites, informing you that by clicking on such links you will be redirected to another page for which ERSHIP is not responsible. You should be aware that the owners of these external websites may collect, use or transfer your personal data under different conditions and terms, and we recommend that when you contact one of these websites, you inform yourself about their privacy policy, general terms of use or the use they may make of their cookies, as we cannot control the way in which these websites use the personal information you disclose.

ERSHIP informs you that it can entrust data processing to third parties in accordance with the regulations in force, demanding from our part that the person in charge of such processing complies with the due guarantees of data protection. The processing orders are strictly necessary for the development of our services and the suppliers have been selected in accordance with the rights that we preserve on this website.

These suppliers will only have access to the information that is necessary to perform their functions and may not use it for other purposes. They must also process personal information in accordance with this Privacy Policy and applicable data protection legislation.

9. What are your rights when you provide us with your data?

You may exercise your rights under the Spanish General Data Protection Regulation and Organic Act 3/2018, on the protection of Personal Data and guarantee of digital rights, free of charge.

Any person has the right to revoke consent, to request access to personal data concerning him/her, to request their rectification or erasure, to request the limitation of their processing, to object to their processing (if there is public interest or legitimate interest) and/or the right of portability.

In order to guarantee the exercise of your rights, ERSHIP GROUP has designated a Data Protection Delegate as Privacy Officer. If you want to claim any of the rights mentioned in the previous paragraph, if you believe that your personal information has been used in a way that does not comply with this policy or with the preferences you have specified, or if you have other questions related to our privacy policy, you can send your request or complaint to the e-mail address dp-datos@ership.com.

Please include in your communication a copy of your ID card, the specific request you are making and your contact details for notification purposes.

Any person may file a complaint with the Spanish Data Protection Agency through the website www.aepd.es if they consider that their rights have not been satisfied.

10. Privacy policy for events

The personal data subject to processing are those that the attendee provides when completing the registration form for the event, or those already processed by Ership Group by virtue of professional and / or business relationships maintained prior to the event. Also, your image and / or voice may appear in the photographs and / or videos that are made.

The personal information provided will be processed for the purposes of sending the invitation, the organization and logistics of the event, access control and the possible subsequent use of the images and videos taken during the event. The legal basis for the treatment is the legitimate interest of Ership Group in the proper management and celebration of the event and the consent given to confirm your attendance, which includes the transfer of your right of image during the celebration of the event.

You have the right to access your personal data being processed, to request the rectification of inaccurate data or, where appropriate, to request its deletion when the data is no longer necessary for the purposes for which it was collected, as well as to exercise the rights of opposition and limitation to the processing and portability of data. You also have the right to withdraw consent at any time, although such withdrawal will not affect the lawfulness of the processing prior to the withdrawal.

You may exercise your right to object to the taking of images or withdraw your consent during the event itself by contacting the organiser to request that your image not be captured or recorded. If, after the event, you exercise your right of objection or withdraw your consent, the images in which you appear will be destroyed immediately.
